Commercial Leases

Phoenix Business Lawyers Negotiate Commercial Leases for Landlords, Tenants and Businesses Large and Small

Knowledgeable Arizona commercial lease attorneys protect your investment

For decades, Phoenix has been one of the fastest growing cities in the United States. The 2010 U.S. Census ranked Phoenix as the sixth largest city by population, with about 80,000 fewer residents than Philadelphia. Phoenix may now have passed Philadelphia to become the fifth largest city in the U.S. Phoenix is the largest city west of the Mississippi after Los Angeles, and people continue to come from all over the country to live, work and retire here. In 2019 200 people a day were moving to Phoenix. And, Maricopa County is once again first, or near the top, in the nation of business activity and growth. This robust growth means that real estate in the Phoenix area is going to continue to increase in value. If you are investing in commercial property to lease, or a tenant seeking to lease such property, you want to make sure you are protected and getting the greatest benefit for your investment. Drawing on decades of experience, the attorneys with the Law Offices of Donald W. Hudspeth P.C. draft commercial leases, review and revise them, and provide consultation and advice about the terms. If necessary, our litigation team can work to resolve commercial lease disputes, so our client landlords or tenants can derive benefits from the property for years to come.

If you are renting or leasing a commercial space, we can negotiate appropriate terms that protect your interests. Certain terms now prevalent are highly favorable for the landlord but not the tenant. In some case a business cannot be sold because of them. We are aware of and draft or revise such clauses. Paramount among the terms is the rent clause. Often there is a base rent, calculated per square foot, and a percentage rent, based on the tenant’s gross sales. Depending on the premises, a tenant might be asked to pay additional rent for common areas. Leases can provide for improvements to be made to the property. . It is now common for landlords to include expansive property upkeep provisions in the definition of “operating expenses” or “common area and maintenance (CAM). For tenants this necessitates what we call our “New York Review” of tenant charges.  Our attorneys negotiate all of these items skillfully to protect our clients’ interests.

When you entrust your real estate transaction to our firm, you get reliable and determined assistance from seasoned attorneys who tackle the details so you can have total peace of mind.
